Please read these Terms and Conditions (“Terms”) carefully before using the website located at keepyourcare.org (the “Site”), operated by Keep Your Care Inc. (“Keep Your Care,” “KYC,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About Keep Your Care; Not a Government Entity
Keep Your Care Inc. is a Delaware nonprofit corporation organized under Section 501(c)(4) of the Internal Revenue Code as a social welfare organization. We are not a government agency, and the Site is not operated, sponsored, endorsed, or affiliated with any federal or state government, Medicaid agency, or other government body, including in any state referenced on the Site. Any references to “Medicaid,” state program names, or government requirements are for informational purposes only. Keep Your Care does not use, and is not authorized to use, any government agency’s official seal, logo, or branding, and nothing on the Site should be understood to represent an official government communication or determination.
2. Purpose of the Site; No Guarantee of Outcomes
The Site is intended to help people understand Medicaid work requirements and other related eligibility rules, and to connect visitors with official government resources, application portals, and other assistance. The Site does not provide legal, medical, financial, or other professional advice, and using the Site does not create any advisory or professional relationship between you and Keep Your Care.
Medicaid work requirements and related rules vary by state and are subject to change at any time. You are solely responsible for confirming current eligibility requirements, deadlines, and application or reporting procedures directly with your state’s official Medicaid agency or other applicable government resource. Keep Your Care does not determine eligibility, does not process applications on the government’s behalf, and makes no representation or warranty — express or implied — that any individual will be found eligible for Medicaid, will successfully complete any application or reporting requirement, or will retain coverage. To the fullest extent permitted by law, Keep Your Care disclaims all responsibility for any loss of coverage, denial of benefits, missed deadline, or other adverse outcome, whether or not related to your use of the Site.
3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to: use the Site in any way that violates applicable law; attempt to gain unauthorized access to the Site or its related systems; use any automated means (such as bots or scrapers) to access the Site without our permission; or interfere with the proper functioning of the Site.
4. Text Messaging Program
Our text messaging program is described in our Privacy Policy, which is incorporated into these Terms by reference. By opting in to receive text messages from Keep Your Care, you agree to the terms described there, including that message frequency varies, message and data rates may apply, and consent to receive text messages is not a condition of any donation or program participation. You may opt out at any time by replying STOP to any message you receive from us.
5. Donations
If Keep Your Care offers the ability to make a donation through the Site, all donations are processed by a third-party payment processor, and your payment information is subject to that processor’s privacy policy and terms, not this one. Donations to Keep Your Care support our mission-related work; unless required by law, donations are non-refundable.
Donations to Keep Your Care are not deductible for federal income tax purposes.
6. Intellectual Property
The Site and its content — including text, graphics, logos, and other materials — are owned by Keep Your Care or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and share content from the Site for noncommercial, informational purposes, but you may not reproduce, modify, distribute, or create derivative works from the Site’s content for commercial purposes without our prior written permission.
7. Third-Party Links
The Site may link to third-party websites or resources, including government websites, that we do not own or control. We are not responsible for the content, accuracy, or practices of any third-party site, and inclusion of a link does not imply our endorsement.
8. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. KEEP YOUR CARE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SITE IS CURRENT, COMPLETE, OR ACCURATE. YOU ARE RESPONSIBLE FOR VERIFYING ANY INFORMATION ON THE SITE, PARTICULARLY REGARDING GOVERNMENT REQUIREMENTS AND DEADLINES, WITH THE APPLICABLE OFFICIAL GOVERNMENT SOURCE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KEEP YOUR CARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF COVERAGE, BENEFITS, INCOME, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL KEEP YOUR CARE’S TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Keep Your Care and its officers, directors, employees, volunteers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will revise the date at the top of these Terms and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
